Brian J. Philpott


Brian J. Philpott is a partner with the firm in the Intellectual Property Practice Group. His practice focuses on patent prosecution and litigation, trademarks, copyrights, internet and domain name matters, and general international intellectual property issues. Mr. Philpott has litigated several intellectual property cases before state and federal courts in California and New York, as well as before the United States Patent and Trademark Office. He represents a diverse clientele including individuals and companies from the fashion, entertainment, and high-tech industries. His technological expertise is in video games, optics and imaging devices, semiconductor technologies, sports equipment, fashion, and e-commerce.

Mr. Philpott earned a Bachelor of Science in Electrical Engineering from Oklahoma State University in 2002. After graduating, he went to work in the Ultrafast Terahertz Optoelectronic Laboratory as a research assistant under Dr. Alan Cheville. In the fall of 2002, he matriculated to the Pepperdine University School of Law where he received his Juris Doctor degree in 2005. While in law school he served as the President of the Intellectual Property Society and actively volunteered with several organizations including the Union Rescue Mission and the Adoption Law Group. He was admitted to the California Bar in January 2006.

Before joining Ferguson Case Orr Paterson, Mr. Philpott was a shareholder with boutique intellectual property firm Koppel Patrick Heybl & Philpott in Westlake Village, California. His previous legal experience includes summer positions with Secrest Hill & Butler in Tulsa, Oklahoma, and Blakely Sokoloff Taylor & Zafman in Los Angeles. During a semester abroad in London, he clerked for Hammonds, a large European firm that specializes in international sports and entertainment issues, including contract negotiation and licensing. While working for Hammonds, he had several articles published, including contributions to the Hammonds Reporter and the Institute of Trade Mark Attorneys monthly journal.

Mr. Philpott is an adjunct professor at Pepperdine University School of Law, where he teaches courses in Patent Law and Trademarks and Unfair Competition.
