Brian M. Fitzgerald


Brian Fitzgerald is an associate in Ferguson Case Orr Paterson’s intellectual property group. He practices primarily in patent prosecution, trademark prosecution, IP licensing agreements and IP litigation, represent from individual inventors to large multinational corporations. Brian has prosecuted patent applications in technologies including medical devices, semiconductor devices, agricultural fluid distribution systems, automotive systems, hermetically sealed electronic switching systems, security systems, 3D printing systems, sound systems,  simple mechanical devices, and designs. In addition to his experience before the USPTO, Brian has extensive experience prosecuting patent applications internationally in Europe, Japan, China, Taiwan, Korea, Russia/Eurasia, Australia, New Zealand, India, Brazil, Mexico and Canada. Brian has litigated IP cases in the Northern District of California, the Central District of California, the District of Oregon, and has appellate experience before the Federal Circuit.

Brian graduated from the University of California, Irvine in 2004 with a double major, receiving a B.S. in Biological Sciences and a B.A. in Political Science. During his time at UCI, Brian conducted neuroscience research at the Roman Reed Core Facility of the Reeve-Irvine Spinal Cord Injury Research Center. Brian’s research included working with Hans Keirstead, a prominent stem cell researcher and working with DNA vaccinations, stem cell technology, virus therapy and robotics. Brian received a grant for his research project concerning a Myelin Tolerizing DNA vaccination.

In 2009, Brian obtained his J.D. from Southwestern Law School and was admitted to the California State Bar the same year. During Law school, Brian had the opportunity to extern for both Los Angeles Superior Court Judge Teresa Sanchez-Gordon and U.S. District Judge, the Hon. Gary Allen Feess, of the Central District of California.

Prior to joining Ferguson Case Orr Paterson, Brian was an associate of the law firm of Koppel Patrick Heybl and Philpott.
